Terms of Service

1. About these terms
These Terms of Service ("Terms") are an agreement between you and FRITZSCH HOLDINGS, LLC, which operates Beyond This Stone ("Beyond This Stone," "we," "us," or "our"). They cover your use of our website at beyondthisstone.com, our app at app.beyondthisstone.com, our storefront, our memorial platform, and the physical QR memorial plates we sell (together, the "Service").
By creating an account, buying a plate, or using the Service in any way, you agree to these Terms. If you do not agree, please do not use the Service.
2. Who can use the Service
You must be at least 18 years old to create an account or make a purchase. By using the Service, you confirm that you are 18 or older and that the information you give us is accurate.
3. Your account
You need an account to build or manage a memorial. You are responsible for your login details and for anything that happens under your account. Keep your password private. Tell us right away if you think someone else is using your account. We may suspend or close accounts that break these Terms.
4. What we sell
We sell a physical QR memorial plate together with access to a digital memorial platform. Some features, extra storage, and AI image credits may be sold as separate purchases inside your account. Current products, prices, and limits are shown on the storefront and in the app.
A memorial page always requires a purchased physical QR code. There are no free memorial pages.
5. Prices, payment, and taxes
Prices are shown at checkout. Physical products are sold through our Shopify storefront. Digital purchases such as storage upgrades, AI credits, and add-ons are handled through our payment processor. All purchases are one-time charges; we do not offer subscriptions or recurring billing. By buying, you authorize the charge and agree that you are responsible for any taxes that apply. We may change prices at any time, but changes will not affect orders you have already placed.
6. The physical plate
The plate has an adhesive backing and is meant to be pressed onto a headstone or memorial surface. You are responsible for placing it correctly and for getting any permission you need from a cemetery, property owner, or other party before you attach it. We do not promise that the adhesive will hold in every condition or on every surface. Please follow the placement instructions included with the product.
7. Creating and managing a memorial
The platform is self-serve. You create, fill in, and manage the memorial yourself. We do not build or populate memorial pages for you.
When you create a memorial for another person or a pet, you confirm that you have the right to do so and that you have permission from anyone who would reasonably need to consent. You are responsible for the content on the memorial and for how it is used.
8. Your content
You keep ownership of the photos, videos, text, and other material you add ("Your Content"). By adding it, you give us a non-exclusive, worldwide, royalty-free license to store, host, display, format, and distribute Your Content for the purpose of running the Service and showing the memorial to the people you allow to see it. This license lasts as long as Your Content is on the Service and for a short period afterward to allow for backups and removal.
You confirm that:
- You own Your Content or have the rights and permissions needed to upload and share it.
- Your Content does not break any law or violate anyone's rights, including the rights of living people who appear in photos or videos.
- Any music, video, or other third-party material you link to or upload is used in a way you are allowed to use it.
You are responsible for keeping your own copies of Your Content. We are not a backup service.
9. Roles, access, and disputes
An owner can invite others to help edit a memorial, set it to public or private, and choose how tributes are published. Different roles have different access, as described in the Service.
We are not able to referee disagreements between family members or others about who should control a memorial or what it should contain. If a dispute arises, the account owner controls the memorial. We may, at our discretion, restrict, transfer, or remove a memorial if we receive a credible legal request or evidence that the owner does not have the right to control it.
10. AI features
Some features use artificial intelligence to generate images or scenes from photos you provide. AI credits are consumable and are used up when you generate content. AI output is created automatically and may be inaccurate, imperfect, or not what you expected. AI features are provided for personal, non-commercial memorial use. You are responsible for the photos you submit and for how you use anything the AI produces. We do not guarantee any specific result and, once a credit is used, it is generally not refundable.
11. Augmented reality feature
The augmented reality feature lets you place a prepared photo into a view of your physical surroundings using your device camera. It is a photo placement feature only. It does not provide precise measurement or full depth tracking, and results depend on your device and lighting.
12. Acceptable use
Your use of the Service is also governed by our Acceptable Use and Content Policy. Please read it. It explains what content is not allowed and how reporting and removal work.
13. Availability and changes to the Service
We work to keep the Service available, but we do not promise that it will always be available or error-free. We may add, change, or remove features at any time.
We host memorial pages while the Service is operating and while your account is in good standing. We cannot promise that any page, feature, or the Service itself will last forever. If we decide to discontinue the Service or a major feature, we will give reasonable advance notice where we can and, where practical, a way to download Your Content.
14. Storage limits
Each memorial includes a base amount of photo and video storage, shown in the app. If you reach a limit, you may be able to buy more storage or use supported workarounds described in the app. We may set or adjust reasonable limits to keep the Service running well.
15. Third-party services
The Service relies on third-party providers for payments, hosting, media storage, email, analytics, and AI features. It may also contain links to sites we do not control. We are not responsible for third-party services or sites, and your use of them is at your own risk and subject to their terms.
16. Our intellectual property
The Service, including our software, design, text, logos, and branding, belongs to us or our licensors. These Terms do not give you any right to use our branding or copy our software except as needed to use the Service normally.
17. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that content will always be preserved.
18. Limitation of liability
To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event that gave rise to the claim.
Some places do not allow certain limits, so parts of this section may not apply to you.
19. Indemnification
You agree to defend and hold us harmless from claims, damages, and costs, including reasonable legal fees, that arise from your content, your use of the Service, or your breach of these Terms.
20. Termination
You can stop using the Service and close your account at any time. We may suspend or end your access if you break these Terms or if we reasonably need to. Some sections, including content licenses needed for backups, intellectual property, disclaimers, limitation of liability, and indemnification, continue to apply after termination.
21. Disputes and governing law
These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law rules. Before filing anything formal, please contact us so we can try to resolve the issue directly. If that does not work, you agree that the state and federal courts located in Nebraska will have exclusive jurisdiction, unless the law where you live requires otherwise.
22. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the date at the top. If a change is significant, we will try to give you notice. Continuing to use the Service after a change means you accept the updated Terms.
